Terms & Conditions

1). All payments to be made to Glenn Mason. Due to fluctuating exchange rates, overseas buyers should send payment in  Australian Dollars, unless other arrangements have been made.

2). All goods are sold on a first come, first served basis. Wherever possible please refrain from calling our office chasing your order as these calls only delay the process further.

3). Postage will be charged on all orders (unless a customer selects local pickup).

We use Australia Post eParcel Post or Express Post, as these two methods are trackable.

We will not be liable for any packages lost in transit, but will assist and pursue avenues to locate packages.

4). Any item may be returned within 7 days of receiving the goods if not completely satisfied. To enable the 7 days to take effect buyers need to email Regimental Books when goods are received.

The refund will be less post and the goods must be returned in the same condition, otherwise refund will not take effect.

5). All items are sold as genuine and original unless otherwise stated. Any militaria item subsequently proven to be fake, renamed or not entitled to bars may be returned and the purchase price will be refunded. It should be noted that many books listed on this website are used and any blemishes or marks are either described in the product description or shown in photographs. Our photographs are used to describe the product so please take note of the photographs when taking into account the condition of items.

6). Our postal charges are based on what Australia Post charge. We also charge a small fee for handling to cover the cost of material.

7) A 2.8% surcharge is added to all credit card purchases. This is what we are charged by the bank. Alternate payment arrangements are available.

8) Many of our descriptions are taken from public sources – Regimental Books would like to thank and acknowledge the Australian War Memorial for it’s publicly provided Battalion and Regimental brief histories.

Digital Licence Agreement (including Downloadable products) / End User License Agreement

IMPORTANT NOTICE: Please read the terms of the following Licence Agreement carefully. The Regimental Books End-User Licence Agreement (“Licence”) sets forth the terms and conditions under which you are licenced to use (“the Product”)s which is any digitally formatted product which is downloaded from this website – www.regimental-books.com.au.

You signify acceptance of the terms of this Licence by clicking “By checking this checkbox, you agree to our Terms & Conditions” or by using the Product.

1. LICENCE 1.1 Subject to clause 1.2, Regimental Books hereby grants you a non-exclusive, revocable, non-transferable licence:
(a) To use any digitally formatted Product which is purchased on a multi site basis, solely for the internal business purposes of your company or place of business. For the purposes of this Licence, “multi site” is defined as multiple physical locations of your company or place of business, which locations may include multiple buildings located on the same property. The Product is licenced for use on several machines within multiple sites.
(b) For the purposes of this Licence, ”internal business purposes” means purposes directly related to the Licensee’s internal business operations, but without limitation does not include providing the Product to third parties in any way.
(c) To make back-up copies of the Product, provided your back-up copies are not used in any other site.
(d) To reproduce, modify, display, distribute and otherwise use the Product in electronic or hard copy form:
(i) for internal documents, publications, presentations and communications;
(ii) on your company’s intranet.
1.2 You may reproduce, modify, display, distribute and use the Product in accordance with the licence in clause 1.1 provided that:
(a) Unless approved by Regimental Books, you may not sell, sub-licence, assign or otherwise distribute the Product or modified versions of the Product as a stand-alone product outside the site(s) licenced;
(b) You may not use the Product in any document or website made available over the internet.

2. INTELLECTUAL PROPERTY RIGHTS
2.1 For the purposes of this Licence, the term “Intellectual Property Rights” means all copyright, patents, registered and unregistered design rights, trademarks and service marks and applications for any of the foregoing, together with all trade secrets, know-how, rights to confidentiality and other intellectual and industrial property rights in all parts of the world.
2.2 You acknowledge that you obtain no Intellectual Property Rights whatsoever in the Product or any associated documentation. As between the parties all Intellectual Property Rights vest in Regimental Books.
2.3 You acknowledge that Intellectual Property Rights in the Product, whether in original or modified form, are and remain the property of Regimental Books and that the Product shall only be used or dealt with by you as provided in the Licence.

3. TERM The Licence is effective until terminated. You may terminate the Licence at any time by destroying the Product. Regimental Books may terminate this Licence immediately by notice to you if you breach the terms of this Licence and fail to remedy the breach within 14 days of becoming aware of it. If Regimental Books terminates the Licence you must immediately destroy the Product together with all copies, modifications or substantial reproductions in any form. This requirement is without prejudice to any other rights and remedies that Regimental Books may have in respect of your breach of this licence.

4. DISCLAIMER OF WARRANTIES
4.1 Regimental Books warrants the Product to be free of material defects in workmanship under normal use for ten days after purchase. During this ten day period you may return the defective Product to Regimental Books via email and it will be replaced without charge unless damaged by accident or misuse.
4.2 Except as above, Regimental Books makes no warranties, express or implied, as to any other matters including but not limited to non-infringement of third party rights, merchantability or fitness for any purpose.
4.3 Where any act of parliament implies in this Licence any term, condition or warranty, and that act avoids or prohibits provisions in a contract excluding or modifying the application of, the exercise of, or liability under that term condition or warranty, such term, condition or warranty shall be deemed to be included in this Licence. However, the liability of Regimental Books for any breach of such term, condition or warranty shall be limited, at the option of Regimental Books, to any one or more of the following:
(a) if the breach relates to goods:
(i) the replacement of the goods or the supply of equivalent goods;
(ii) the repair of such goods;
(iii) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
(iv) the payment of the cost of having the goods repaired; and
(b) if the breach relates to services:
(i) supplying of the services again; or
(ii) the payment of the cost of having the services supplied again.
4.4 You warrant that you have not relied on any representation made by Regimental Books which has not been stated expressly in this Licence or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity produced by Regimental Books.

5. LIMITATION OF LIABILITY
5.1 Unless this Licence expressly provides otherwise:
(a) to the maximum extent permitted by law, all express and implied conditions, warranties or liabilities (including liability as to negligence) regarding the condition, accuracy, suitability, quality or title to the Product contained therein are negated and excluded; and
(b) Regimental Books gives no condition, warranty, undertaking or representation in relation to the condition, accuracy, suitability, quality of or title to the Product contained therein (including any material produced by or with the aid of any of them). The Product is not tailored to any user and is not a substitute for expert advice on your particular circumstances.
5.2 Regimental Books’ liability to you for all loss, damage, costs, expenses, claims, demands, actions and proceedings arising out of or in connection with this Licence, whether arising under common law (including negligence) or under statute, will be limited to the following extent:
(a) Notwithstanding anything in this clause 5.2 or in any other provision of this Licence, Regimental Books will not be liable for any direct or indirect lost profit or revenue, exemplary damages, loss of goodwill, deletion or corruption of electronically or digitally stored information, or without limiting the foregoing, any indirect or consequential loss or damage howsoever described or claimed;
(b) The Regimental Books’ liability to you for any proven loss or damage suffered by you relating to death or personal injury or damage to any real property or chattels caused by an act or omission of the Regimental Books will be limited for an aggregate of all claims to $10.00; and
(c) Otherwise in respect to all other claims Regimental Books’ liability to you for all other proven loss and damage is limited for an aggregate of all claims to the amount paid by you for the Product.

6. MILITARY HISTORY RESEARCH BRIEFS
6.1 The Military History Research Brief Series of eBooks are sold on the condition of not being copied and distributed to other parties. Regimental Books limits these eBooks to a single copy on a single machine.
6.2 In relation to the sale of each digital copy of the Military History Research Brief Series of eBooks, the buyer acknowledges that each sale (commercial transaction) is considered to be for only the digitisation and compilation services required to compile the data into an electronic format for distribution. All data within each electronic document has been compiled from various public sources and no copyright is held on that data by Regimental Books.

7 REFUNDS
7.1 A refund for a digital product will only be given if the product is defective or otherwise unusable. No refunds will be given for changes of mind.
